Supreme Court: On Tuesday (September 24), the Supreme Court reprimanded the NCPCR i.e. National Commission for Protection of Child Rights. The Supreme Court also made a strong comment while rejecting a petition of NCPCR. The Supreme Court said that do not drag us into your agenda.

In fact, a petition was filed in the Supreme Court demanding the formation of an SIT on the cases of children allegedly sold through shelter homes in Jharkhand. These shelter homes are run under the Missionaries of Charity established by Mother Teresa.

What did the Supreme Court say?

The bench of Justice BV Nagarathna and N Kotishwar Singh reprimanded the NCPCR and said that the relief sought in the petition is vague and cannot be considered. In this regard, the bench of Justice BV Nagarathna and N Kotishwar Singh also asked several questions to the lawyer appearing on behalf of NCPCR.

What did the bench ask the lawyer?

The bench asked the NCPCR lawyer on this matter that what kind of relief is sought in your petition and how can we pass such instructions. The Supreme Court also said that this petition is completely wrong. The same lawyer told the Supreme Court that the petition has directed a time-bound investigation of all such organizations in Jharkhand under the supervision of the top court.

‘NCPCR has the authority’

The Supreme Court said that under the Commission for Protection of Child Rights (CPCR) Act, 2005, the NCPCR has the right to investigate as well as take legal action. The National Commission for Protection of Child Rights had filed a petition in 2020 seeking enforcement of the fundamental rights to prohibit human trafficking guaranteed under Article 23.
