Yogendra Yadav Bablu, son of Nanhe Yadav, who killed CO Ziaul Haq by shooting him with a pistol, was earlier found to be a minor. There were also speculations that Raghuraj Pratap Singh ‘Raja Bhaiya’ was behind this accident.
Actually, after the death of his father, Bablu, upset with the death of uncle Suresh Yadav, shot the CO with a pistol. The rest of the people were beating the CO with sticks. When the CBI investigated, it was claimed that he was a minor, after which his case was sent to the Juvenile Justice Board, Lucknow (JJ Board). His family members presented Bablu’s high school mark sheet, which showed his date of birth as 15 May 1996. The board called for his educational documents for investigation, in which after finding a lot of truncation, his date of birth recorded in the 10th class mark sheet was declared wrong.
Considering Bablu’s age at the time of the crime as 18 years 2 months 15 days, the board had ordered to send him to District Jail, Lucknow. Chief Justice of the Board Udayveer Singh and members Dinesh Pandey and Dr. Rashmi Rastogi had written in their decision that it is clear in the educational documents that to change the date of birth, the date of birth recorded in the educational documents from 2007-08 onwards has to be changed. Referring to Rule 12(3)1 of the Juvenile Justice (Care and Protection of Children) Rules 2007, the Board had said that in determining the age, the 10th class mark sheet has been considered as the first evidence and in case of its not being available, it will be considered as the first evidence. Certificate of date of attending bar school has been accepted.
The decision had to be written by hand
At that time, the condition of the board was such that there was no clerk to write down an important decision of the Kunda scandal which had become a disgrace for the state government. The only clerk appointed to the board was on leave, as a result board member Dr Rashmi Rastogi had to handwrite the 17-page decision, which took hours.
Raja Bhaiya was sued
After Bablu’s death due to collision with a truck, the family members had filed a case against five people including former minister Raghuraj Pratap Singh alias Raja Bhaiya and MLC Akshay Pratap Singh alias Gopal ji, accusing them of murder and hatching a conspiracy. Considering the sensitivity of the matter, a team from Forensic Science Laboratory of Lucknow was sent for investigation.
