Recently, a similar case came to light in Noida. Here, Rs 26 lakh was sent to a person’s account by mistake. As soon as the person saw the money, he withdrew the money from the account and spent it.
If any person ever does this, the bank can file a case against him under Section 406 of the Indian Penal Code. In such a case, if the person is found guilty, he can be sentenced to three years of imprisonment. Apart from this, a case for recovery of money can also be filed against the person under Section 34 and 36. In such a situation, the court will look at all types of properties of the accused and attach them and then the money will be recovered through that property.
