All Property Of Legally Acquired Land Belongs To The Government – Amar Ujala Hindi News Live

The Allahabad High Court has said that if the government has acquired the land following the legal process and has taken possession by declaring the award, then there is no need to adopt any separate legal process to remove the construction on that land. This order has been given by the division bench of Justice Ashwani Kumar Mishra and Justice SQHR Rizvi while hearing the petition of Deepak Sharma. The petitioner had sought a ban on the demolition of six shops built on the acquired land of village Tusiyan in Dadri, Greater Noida.

The petitioner’s advocate said that his land was acquired in 2006 under the emergency clause. The authority has also taken possession and the award has also been declared. He has not challenged the award and acquisition. There has been a demand to separate the populated area on the land acquired only on the basis of the government order of 24 April 2010. Therefore, eviction and interference in its possession should be prevented.

Authority’s advocate Anjali Upadhyay said that the acquisition process has been completed. The award has also been announced by District Magistrate Gautam Buddha Nagar. The authority has taken the land into its possession. Now the petitioner has no right on the land. The petitioner said that the eviction should be done only after adopting the legal process. The court said that the acquisition has been done as per the law. The property has vested in the government. The demand for a separate legal process is misleading.
