Rules Regarding Body Shaming: All Indian citizens have freedom of expression under Article 19(1)(a) of the Indian Constitution. That means any citizen can do or say whatever he wants. There will be no restriction of any kind on that. But nowadays people are using freedom of expression in very wrong ways. People say many such things as an individual’s freedom. Which perhaps he shouldn’t have said.
In the name of freedom of expression, people are doing a lot of body shaming these days. That means calling people fat, dwarf, if someone has dark complexion then call him black. Law regarding body shaming
Currently, no official law has been made in India regarding body shaming. That means no such specific section has been added to the Constitution. Due to which making inappropriate physical comments on someone is considered a crime. In short, there is no legal term for body shaming.
But if you body shame someone. They try to humiliate someone because of his physical appearance. Then a case can be filed against you under defamation. In which under section 399 of IPC, you can be jailed for up to 2 years.
A case of abetment to suicide can also be registered
Generally people take body shaming very lightly. In a way, it is like ragging in schools and colleges. When ragging is done, it has a very negative impact on some students. There have even been cases of students attempting to take their own lives.
Body shaming is also similar in a way. You repeatedly taunt someone about his physical appearance. They make fun of him and humiliate him. So in such cases, people often get fed up and try to commit suicide. If this happens, then a case of abetment to suicide can also be registered against those doing body shaming.
