Compensation is available under Railway Act
Often accidents happen in trains operated by Indian Railways and even in the premises of Indian Railways. Many times people get seriously injured in accidents and sometimes they even lose their lives. All victims of an accident are entitled to compensation from the Railways. But they do not have much information about how to apply for compensation and make a claim.
Let us tell you that under Section 124 of the Railway Act 1989 of the Indian Railways, there is a provision to give compensation on behalf of the Railways to the victims of any accident caused by the Railways. It has been decided by Section 1 124A of the Act that in any way in the railway premises. Even if a passenger dies, the Railways is responsible and has to pay compensation.
Application for claim can be made to Railway Claims Tribunal.
Earlier, if there was an accident in Indian Railways, someone had to take compensation. So the application for claim had to be made at the place of the accident itself. But there was a change in the railway rules and after this any aggrieved person can apply for this in his regional railway bench. If a passenger has died caused by railway property, he can apply for compensation in the Railway Claims Tribunal.
For this he has to submit some documents along with him. Post mortem report in case of death. medical report. And certificate. The claim has to be filed before the RCT i.e. Railway Claims Tribunal including nominee details, date of incident and some other information.
