Punishment for abuse: You must have often seen that people start abusing each other over trivial matters. They start misbehaving. You must have seen many videos of people abusing and misbehaving with each other on social media. Sometimes the fight gets so intense that people even start threatening each other with death.
But in such cases, people are often unaware that the abuses they are using may cost them dearly later on. Many people abuse their friends during conversations but they are unaware of it. You may even have to go to jail for abusing. Let’s know what the law says about this.
Abuse is a crime
If someone abuses someone or behaves indecently with someone, then such cases are criminal. In such cases, a case is registered in the police station under Section 154 of CrPC. Under Section 294 of the Indian Panel Code, abusing someone obscenely is a legal offense.
Usually in cases of abuse and indecency, people settle the case by reaching a compromise. But if a case is filed under Section 294, then you cannot compromise in it. Because it hurts people’s feelings.
What could be the punishment?
Under Section 294 of the Indian Penal Code, the accused in this case can be sentenced to up to 3 months. Generally, the accused are not sent to jail in such cases. But they have to pay a fine in lieu of this. But if the case gets serious, then they may have to go to jail.
What if I am threatened with death?
Often when there is a fight between one party and the other, many people abuse each other with obscene language. Many times people even threaten to kill each other. You must have seen this often in fights in wedding parties. You must have seen it in fights in conferences. People do this during fights in many societies.
But let me tell you that threatening to kill someone is not limited to just threatening but it is a crime. In this case, an FIR can be lodged against the person threatening by going to the police station. Under Section 506 of the Indian Penal Code, a person can be imprisoned for up to 7 years for threatening to kill someone.
