BSA silence for 30 days on approval, tantamount to approval, order to reinstate salary to teacher – Amar Ujala Hindi News Live

Allahabad High Court said that the silence of BSA for 30 days on the documents sent for approval of appointment will be considered as his approval under UP Basic School Rule 10. This comment was made by a single bench of Justice Piyush Agarwal while accepting the petition filed on behalf of petitioner Kavita Singh.

The court directed the BSA Allahabad to verify the experience certificate within a month to the respondents. It was held that if the document is found to be genuine, the petitioner should be allowed to continue in the post of Principal. On this condition, the court further directed that the petitioner will be paid the arrears of his salary and he will also continue to receive his monthly salary. The case is from Prayagraj.

The petitioner was appointed as Assistant Teacher in Dr. Ambedkar Junior High School, Kaushambi by the District Basic Education Officer on 17 October 2015. He worked on the said post for 19 years. In 2016, Ram Kali Balika Pre Madhyamik Vidyalaya, Allahabad advertised vacancies for several posts, under which the petitioner applied for the post of Principal.

The petitioner was selected. He also took charge. When he filed a petition in the High Court for not getting the salary, the appointing authority declared him ineligible for appointment citing the absence of experience certificate and approval from BSA in the petitioner’s documents. The petitioner knocked the door of the High Court against this.
