Supreme Court on Same Gender Marriage: The Supreme Court has listed the petitions seeking review of the decision refusing to recognize gay marriage for July 10. A five-judge bench of Chief Justice DY Chandrachud, Justice Sanjiv Khanna, Justice Hima Kohli, Justice BV Nagarathna and Justice PS Narasimha will hear the review petitions.
The court refused to recognize gay marriage
In October last year, a five-judge bench of the Supreme Court had unanimously ruled against legalising gay marriage in India. A bench headed by Chief Justice of India (CJI) DY Chandrachud had delivered the verdict by a majority of 3:2.
The Supreme Court on October 17, 2023 refused to legalise gay marriages in India, saying it was a matter for the legislature. However, all the judges on the bench agreed to form a committee to examine the rights and entitlements of individuals in gay marriages whose relationship has not been legally recognised as marriage.
The Supreme Court will hear on July 10 petitions seeking review of the top court’s judgement that had refused to legalise same-sex marriage.

The court had also unanimously held that gay couples have the right to live together without any threat of violence, coercion or interference, but refrained from giving any direction to formally recognise such relationships as marriage.

Now once again review petitions were filed in the court, in which the decision was termed wrong for not giving any legal protection to gay couples despite acknowledging the discrimination they face. It was said in the petition that it is the duty of the Supreme Court to protect fundamental rights.
