The court expressed displeasure over the attitude of the Railways in not granting sanction to prosecute the accused.

New Delhi. The court has held seven railway officials responsible in the case of death of a woman due to electrocution in the premises of New Delhi Railway Station. The court also expressed displeasure over the attitude of the Railways in not granting sanction to prosecute the accused and termed their transfer as wrong merely for such an irresponsible incident and said that protection cannot be provided to the accused. Taking cognizance of the chargesheet filed by the police, the court has summoned the accused.
In this case, the police had filed a charge sheet against Railway’s SSE Power Supply Bharat Bhushan, Gopal Kumar, Technician Jagdish Kumar, Sita Ram, Wireman Narayan Singh, Manish Kumar and Deepak Kumar, but the case was stuck due to non-approval by the Railways. Railways had argued that these officers have been transferred and major punishment has been imposed on them. Sakshi Ahuja died due to electric shock on 25 June 23.
Citing a Supreme Court case, the court said that the accused cannot thus be provided protection under Section 197 of the CrPC. The court said that it is clear from the evidence presented, medical and CSFL reports that the wires of the electric pole at the railway station were open and the woman died due to being hit by them. The accused were responsible for the maintenance there. In such a situation, they take cognizance of the chargesheet presented by the police and summon the accused.
