The future of Delhi Chief Minister and Aam Aadmi Party national convenor Arvind Kejriwal is at stake. If ED proves that one ‘link’, then Kejriwal is sure to be in danger. When does the interrogation or arrest take place?

Former Deputy Director Satyendra Singh, who worked in ED for more than three decades, says that action has been taken on the basis of evidence in the alleged liquor scam of Delhi. The investigating agency does not lay hands on anyone without evidence. When the links of a case connect with the accused, only then does the ED interrogate him. If something has to be recovered, he is arrested. ED has strong links against the accused for his involvement in that case, but if he does not join the interrogation, then in that situation the only option left is arrest. If a person has given a statement to the investigating agency, and the name of the Chief Minister has appeared in it, then the authenticity of that ‘link’ is ascertained. If that link is seen to be strongly connected with the Chief Minister or his close associates, then CM Kejriwal may be in danger.

That link can be in any form

According to former ED Deputy Director Satyendra Singh, in the investigation of any case, it is found out who else are involved in it. What kind of link is there between them. Is that link connecting directly and clearly to Chief Minister Kejriwal and his close ones? That link can be in any form. Meaning, it includes telephonic conversation, exchange of messages, email or face to face conversation, etc. If such a strong link is found, then the investigating agency can easily reach the Chief Minister. After this, summons can be sent to the Chief Minister. If the investigating agency feels that some important documents related to the case have to be collected, then a raid can also be conducted. If a search is conducted then the statement is taken. All the action of the investigating agency depends on the basis of evidence. There is no hard and fast rule regarding how many summons can be issued to a person to attend the inquiry. It depends on the willingness of the agency as to how many summons should be issued to whom.

Manish Sisodia and Sanjay Singh arrested

The new liquor policy in Delhi was implemented in 2021-22. This business was handed over to private hands. There are allegations in this case that dealers have been benefited in the new liquor policy. In this regard, the Lieutenant Governor of Delhi had also sought a report from the Chief Secretary. Allegations of scam worth about Rs 144 crore were handed over to CBI. In February 2023, Deputy CM and Excise Minister Manish Sisodia was arrested. After CBI, ED also registered a case of money laundering in August 2022. After investigation, accused Vijay Nair was arrested. CBI filed charge sheet in November 2022. After that Manish Sisodia was arrested. CBI had interrogated CM Kejriwal in April 2023. After this, Rajya Sabha MP Sanjay Singh was arrested in October 2023. In this case, summons were sent to Kejriwal thrice to appear before the ED. The third summons was sent on January 3, 2024. Kejriwal has not yet appeared before the investigating agency. ED can again send summons to Kejriwal. The investigating agency can demand the issuance of a warrant in the court. For this, ED will have to present concrete evidence before the court.

Excise Department Secretary’s statement is important

The special thing is that the investigating agency does not have the name of Chief Minister Kejriwal as an accused. His name is not in the FIR. Kejriwal’s name is not even in the charge sheet. Kejriwal’s name has been mentioned in the remand notes of both the investigating agencies. There is said to be a link here. C. Arvind, who was the Secretary in the Excise Department of Delhi, had admitted during interrogation before the investigating agency that in March 2021, the then Deputy CM Manish Sisodia, who was in charge of the Excise Department, had called him at Kejriwal’s residence. According to the statement given in the investigating agency, the then Health Minister Satyendar Jain was also present there. In the same meeting, there was talk of preparing a draft to increase the commission for liquor traders. The profit margin for liquor traders will be fixed at 12 percent, this thing was finalized at Kejriwal’s house itself. Although this was in the form of a verbal order. CBI has arrested C. Arvind and former Excise Commissioner A. in this case. Gopi Krishna was interrogated by making him sit in front of Sisodia. Kejriwal had made a video call on Face Time from the phone of accused Vijay Nair and told him that Vijay Nair is his child. Those people can trust him.

Conspiracy to arrest Kejriwal

Kejriwal did not appear before the ED even on January 3. In this regard, he has sent a written reply to the investigating agency. In this, Kejriwal has declared the ED notice illegal. Atishi, a minister in the Delhi government, said that the notices being sent repeatedly through ED are motivated by politics of revenge. In his notice, Kejriwal is asking ED why he is being called for questioning again and again. The investigating agency has not responded to this matter. Atishi said that Kejriwal has questioned the ED, in what capacity he is being called for questioning, be it a witness or an accused. ED has also not given any answer to this. According to Atishi, BJP has made ED and CBI a political tool to target the opposition. Notices are being sent to Kejriwal again and again so that he cannot campaign in the Lok Sabha elections. There is a conspiracy to arrest Kejriwal.
