A ward councillor lost his seat in Sitamarhi. He is accused of participating in panchayat elections by submitting a false affidavit and winning the election. Now the State Election Commission has disqualified him and removed him from the post. The commission has also directed the DM cum Returning Officer to take legal action against the removed ward councillor. The case pertains to Sursand Nagar Panchayat.

Usha Devi is the ward councillor of Sursand ward number 11. The State Election Commission has declared her ineligible and removed her from the post. The commission has also directed the DM cum Returning Officer to take legal action against the removed ward councillor Usha Devi. Ward number 14 resident Ramnaresh Barik had filed a case against the said ward councillor by complaining to the State Election Commission. In the case filed, the ward councillor was accused of contesting the election by presenting wrong facts and affidavits despite having more than two children.

During the hearing of the case, the State Election Commission, after hearing the arguments of both the parties, found in the investigation of the presented certificates and other evidence that the accused ward councilor Usha Devi and her husband Jailal Mukhiya have three children, Lalmohan Kumar, Soni Kumari and Ayush Kumar. The birth certificates of the three children have been issued from CHC Sursand. During this time, the husband of the ward councilor had requested to cancel his name as the father of the child and mention the name of the Padarth Mukhiya, stating that he had voluntarily given one of his sons for adoption to Padarth Mukhiya. But the commission did not consider it correct. The State Election Commission got it investigated by the district administration. The district administration has also confirmed the existence of three children in the investigation. After hearing both the parties, the State Election Commissioner has accepted that Usha Devi was not eligible for election after April 4, 2008 due to having more than two children.

There is an allegation of hiding facts and giving false affidavit

The ward councillor is accused of hiding facts and submitting a false affidavit and being elected to the post of ward councillor of ward number 11 of Nagar Panchayat Sursand. Therefore, the commission has disqualified Usha Devi from the post under the powers conferred under the said section read with section 18 (2) of the Bihar Municipality Act, as she was not eligible under section 18 (1) (M) of the Bihar Municipality Act 2007 and has removed her from the post. Along with this, the District Election Officer cum DM has been ordered to take legal action as per rules under section 447 of the Municipality Act 2007 and other relevant sections and inform the commission about the action taken.
