JDU has 45 MLAs in Bihar Assembly, but Legislative Council member Nitish Kumar is the Chief Minister. Similarly, Bharatiya Janata Party, which has 78 MLAs, has given the second position in the government to Bihar Legislative Council member Samrat Chaudhary.
