Incident of 2002

Life imprisonment in 2008

On January 21, 2008, the special CBI court of Mumbai sentenced 11 people to life imprisonment. In 2017, the Bombay High Court and later the Supreme Court also upheld the sentence.

On May 13, 2022, the bench of Supreme Court Justices Ajay Rastogi and Vikram Nath, while giving its verdict on the petition of a convict Radheshyam Shah, had said that he The sentence was awarded in 2008, hence, for release, the 1992 rules would be applicable as those rules were in force at that time. In the rules of 1992, it was said that the release of prisoners sentenced to life imprisonment should be considered after 14 years.
On August 15, 2022, the Gujarat government had released 11 people who had served 14 years of imprisonment on this basis, but in the new decision, the bench of Justices BV Nagarathna and Ujjwal Bhuiyan said that the accused did not tell the court that his The decision of release could have been taken by the Maharashtra government. He had obtained the order from the Supreme Court by telling wrong facts, hence, that order will not have any effect.
