But do you know what action can be taken against an MP if he sits in the House without taking the oath?

Article 99 of the Constitution makes it compulsory for MPs to take oath. But if an MP sits in the House without taking oath, what action can be taken against him? Let us tell you that according to Article 99, before taking his seat in the Lok Sabha House of Parliament, every member has to take oath in front of the President or a person appointed by him for this work. The format of this oath is given in the third schedule of the Constitution.

According to the Constitution, it is mandatory for every member of the House to take oath. But if someone is sitting in the House without taking oath, then in that case further action will be taken under Article 104 of the Constitution. According to Article 104, if a person sits in the House as a member before complying with the requirements of Article 99 (taking oath), or knowing that he is not eligible or he is ineligible for membership or he is prohibited by law from doing so, then he has to pay a fine of Rs 500.
Difference in oath taken by Prime Minister and members
Let us tell you that the Prime Minister and the Union Ministers have to take two oaths. One is for the post and the other is of secrecy. Whereas a Member of Parliament has to take only one oath.

That I will faithfully and conscientiously discharge my duties as Prime Minister of the Union. And that I will do justice to all manner of people without fear or favour, affection or ill-will according to the Constitution and the law.

I swear in the name of God that I will not communicate or disclose, directly or indirectly, any matter which comes to my consideration or becomes known to me as Prime Minister/Minister of the Union, to any person or persons except when required to do so in the discharge of my duties as Prime Minister.
Oath of Member of Lok Sabha
I , having been elected a member of the Lok Sabha, do swear in the name of God that I will bear true faith and allegiance to the Constitution of India as by law established, that I will uphold the sovereignty and integrity of India and that I will faithfully discharge the duties of the office I am about to assume.
