The Delhi High Court on Friday refused to entertain a plea seeking declaration of Shri Ram Janmabhoomi Teerth Kshetra Trust as a public authority. Both the Ministry of Home Affairs (MHA) and the Ram Janmabhoomi Trust opposed the petition before a bench of Justice Sanjeev Narula.

ASG Chetan Sharma and CGSC Nishant Gautam argued that the trust is an autonomous body and should not be classified as a public authority. Accepting their arguments, the court refused to interfere in the matter and disposed of the petition.

The plea filed by Neeraj Kumar challenged the July 8, 2022 decision of the Central Information Commission (CIC) refusing to disclose details about the Chief Public Information Officer (CPIO) of the Trust and the First Appellate Authority. Had gone. Kumar had also filed an RTI request with the Ministry of Home Affairs (MHA) in July 2022 seeking similar information, but it was rejected by the MHA.

The ministry argued that Shri Ram Janmabhoomi Teerth Kshetra Trust is neither owned, controlled nor financed by the Government of India and hence does not fall within the definition of a public authority. Advocate Prashant Bhushan, appearing for the petitioner, sought the intervention of the Delhi High Court to reverse the CIC order.
