If a farmer does not get any goods according to the conditions, then the legal doors are open for his legal rights. One such case has come to the fore from Madhya Pradesh. Bad quality seeds were given to the farmer. The farmers fought a legal battle considering it as their right. When the father died, the son took over the responsibility. Government department lost in front of son’s struggle. The commission has ordered to pay Rs 1.05 lakh to each farmer.

Complaint did not resolve

The matter is related to Khargone in Madhya Pradesh. According to media reports, Madhya Pradesh State Seed and Farm Development Corporation distributed poor quality soybean seeds in June 2014. Due to the quality, the yield of seeds was very less. Farmers complained about this to the Deputy Director of Farmers Welfare and Agriculture Development Department. But no action was taken from the level of the officers. The farmers complained to the District Consumer Commission. The commission accepted the complaint of the farmers as correct. But the Corporation did not agree with the order of the Commission and filed an appeal in the State Consumer Commission. The Forum accepted the complaint of the farmers after a long hearing.

Every farmer will get Rs 1.05 lakh

The commission has ordered that the Madhya Pradesh State Seed and Farm Development Corporation will have to compensate for the supply of quality seeds. Now the loss has to be compensated. This decision has been given by the State Consumer Commission. The corporation will give a compensation of Rs 1.05 lakh to each farmer. 10 farmers will be benefitted by this.

Son demanded legal rights after father’s death

Manohar, father of farmer Hitendra Raghuvanshi of Khargone, had bought 5.10 quintals of soyabean seeds of JS-9560 variety from the corporation for an amount of Rs 34 thousand 170. Even if the seeds were sown in the field, they did not yield properly. The reason behind this was the poor quality of the seeds. When I complained about this to the local authorities, they did not take any action. Later, when father Manohar died, son Hitendra continued the process of legal battle. The Consumer Commission has given its verdict regarding about 10 farmers of Khargone district.

This was the logic of the Seed Corporation

Seed Corporation also argued in its favor. It was said in the argument that the seeds are sold after getting them certified from the MP Seed Certification Agency. The day the seed was sown. It rained more that day. According to the Meteorological Department, 22.9 mm of rain was recorded. Because of this the germination of the seeds was affected. Germination of seeds sown at greater depth. The germination of seeds depends on various factors including weather, environment and quality of agricultural land. The commission rejected all the arguments of the Seed Corporation and directed to pay compensation of Rs 99,520 to the farmer in a month. Apart from this, six thousand rupees will also have to be paid for deficiency in service.
