The Delhi High Court observed that counterfeiting is a very serious matter, which has far reaching ramifications and has a serious impact on the fabric of the national economy in the long run. The court made this observation while hearing a case of shopkeeper selling fake belt. In this case, the court has ordered Louis Vuitton to pay five lakhs. If he fails to do so, he will have to serve a jail term of one week.

Justice C Hari Shankar said it was a commercial evil destroying the brand value and duplicity with the trusting consumer. Counterfeit goods completely waive any right to equitable consideration by a court of law acting within the limits of the rule of law. He doesn’t deserve any sympathy. Courts need to be economically and socially sensitive, and need to send a deterrent message to others.

The court made the observation while directing a Delhi-based store owner to pay five lakh as damages to French luxury fashion house Louis Vuitton (LV) for selling its counterfeit products. The court gave this direction while considering an application filed by Louis Vuitton (LV) relating to trademark infringement. It was alleged in the application that the respondent Javed Ansari was selling counterfeit LV products despite the September 2021 injunction order of the court.
