Delhi Excise Policy Scam: In the Delhi Excise Policy case, Bharat Rashtra Samiti (BRS) leader K Kavita has urged the CBI that the notice sent to her should be withdrawn. K Kavita has been asked by the investigating agency to appear at the CBI headquarters in Delhi on Monday (February 26) under Section 41A of the CrPC.

K Kavitha is the daughter of former Telangana Chief Minister K Chandrashekhar Rao. He has written a letter to the investigating agency. K Kavita has written in the letter that in view of her heavy commitments, the notice to appear at the CBI headquarters should be postponed. He has emphasized the need for his personal presence during the parliamentary elections in Telangana.

K Kavitha said that the notice under Section 41A of CrPC is in stark contrast to the earlier notice under Section 160 of CrPC, which was issued to him on December 2, 2022 and which has already been complied with.

K Kavita raised questions on CBI notice

In a letter to CBI, K Kavitha said, “There is no logic, reason or background as to how, why and under what circumstances you have now resorted to Section 41A of CrPC.”

Section 41A of CrPC deals with suspects. Under this section, a notice is issued to a person against whom there is reasonable suspicion that he has committed a cognizable offence. At the same time, Section 160 of CrPC is related to calling witnesses.

Kavita said that if needed, she will be present through digital medium to answer any questions with prior notice.

The CBI had recorded K Kavitha’s statement in connection with the case at her residence in Hyderabad in December 2022. The ED has alleged that Vijay Nair, an accused in the case, received bribes worth at least Rs 100 crore from a group called South Group (controlled by Sarath Reddy, K Kavitha and Magunta Srinivasulu Reddy) on behalf of Aam Aadmi Party leaders.
