The High Court has asked the Central Government, the Health and Family Welfare Department of the Delhi Government, the Accreditation Board for Calibration Laboratories (NABL) and the Central Bureau of Investigation (CBI) to take action against pathological laboratories that collect blood and other samples illegally and give false medical reports. Answer has been sought from CBI. The bench of Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora issued notice to everyone and adjourned the hearing to April 30, directing them to reply.

The PIL has alleged that some of those labs do not even have a license to take samples. Many have only collection centres, but no laboratories. Petitioner Vipul Goyal has demanded investigation and appropriate action against those pathological labs for allegedly hatching a conspiracy and illegally collecting and testing samples and has asked for instructions to the authorities in the same regard. He said that false medical reports are being issued. Such labs are cheating people and have earned more than Rs 150 crore in this way.

NABL’s counsel said it had withdrawn the recognition given to one of the labs mentioned in the petition last year. It was said in the petition that these labs do not have the required permission and recognition from the appropriate authorities. But such labs have advertised themselves as being NABL accredited. Whereas this is a complete lie. The labs have collected more than Rs 150 crore by misleading and cheating the public. The petitioner said that he used to get his tests done in some of these labs. The petitioner has stated that he had sent several emails and complaints to the concerned authorities for action, but the same were not considered.
