Delhi’s Saket court on Saturday granted bail to former real estate company Unitech promoters Sanjay Chandra and Ajay Chandra in a case related to allegedly duping home buyers. The court said that he had been in jail for almost six years and due to the large number of witnesses in the case, further interrogation and trial were likely to take a lot of time. However, the Chandra brothers will remain in jail as they are accused in a money laundering case.
Additional Sessions Judge Navjit Budhiraja said that the accused had to remain in prison for a long time and due to the huge number of witnesses, further interrogation and trial were likely to take a lot of time. Therefore the nature and enormity of the offense must be balanced with the aspect of fundamental right of the offender to ensure speedy trial.
The court said the duo were behind bars for more than six years and the charges framed against them under Indian Penal Code section 420 (fraudulently and dishonestly inducing delivery of property) carry a maximum punishment of seven years. There is provision. It said the number of witnesses cited by the prosecution is more than 240 and their investigation will take considerable time considering the increasing number of courts.
