what was the whole matter
Last year i.e. in November 2023, Noida Police had registered a case against seven people including Elvish Yadav for smuggling of snake venom. In this case, Noida Police had also arrested five people from Sevron Banquet Hall in Sector 51. These included Rahul, Titunath, Jai Karan, Narayan and Ravinath.
20 ml of snake venom, 9 live snakes, including 5 cobras, one python, 2 two-headed snakes and one red snake were also recovered from these people. At that time it was said that the arrest of these five took place on the initiative of BJP leader Maneka Gandhi’s animal welfare organization PF. However, Elvish was not arrested at that time.
Now a case has been registered under these sections
Now on the basis of sufficient evidence, Noida Sector 49 police has registered a case against Elvish Yadav. At present the Sector 20 police is investigating this case. According to the information, a case has been registered against Elvish Yadav under sections 284, 289, 120B of IPC and sections 9, 39, 48, 49, 50, 51 of Wild Life Protection Act-1972. Apart from this, after investigation of snake venom recovered from the accused, sections of NDPS Act have been increased in this case.
How much punishment can be given under these sections
First of all understand the NDPS Act. Actually, NDPS Act i.e. Narcotic Drugs and Psychotropic Substances Act is used against someone when the case is related to any kind of deadly banned drugs. Snake venom is also used as drugs. This is the reason why a case has also been registered in this matter under the NDPS Act. If the charges under this Act are proved then the accused can be sentenced to 10 to 20 years of imprisonment and a fine of Rs 1 to 2 lakh can also be imposed on him.
Under the sections of the Wildlife Protection Act under which the case has been registered against Elvish, the punishment can be three to seven years’ imprisonment. Whereas, if someone is found guilty under sections 284 and 289 of the IPC, he may be jailed for 6 months and may also be fined Rs 1,000. If the charges against you are proved under Section 120B of the IPC, you can be sentenced to life imprisonment or rigorous imprisonment for 2 years or more.
