Supreme Court on Menstrual Leave: A public interest litigation was filed in the Supreme Court on Tuesday (January 10) to make provision for leave for women every month for problems related to menstruation.
The petitioner told that leave is given for pregnancy, but not for menstruation. Some states have made provision for 2 days leave in a month. Everyone should be instructed to make such rules. This petition was filed by advocate Shailendra Mani Tripathi.
What was said in the petition?
Citing a study by the University College of London, the petitioner said that women suffer as much pain during periods as a person suffers from a heart attack. In such a situation, it reduces the productivity of the employee. The petition states that some Indian companies such as Ivipanan, Zomoto, Byju, Swiggy, Matrubhumi, Magzter, Industries, ARC , FlyMyBiz and Gozoop offer paid periods leave.
‘Equal treatment’
It was said in the petition that women should be treated equally. In different states of India, different treatment is done regarding periods leave. In such a situation, when women have Indian citizenship, then why are they being treated differently. It was told in the petition that in 2018, Shashi Tharoor had introduced the Women’s Sexual Reproductive and Menstrual Rights Bill. In this, it was said that the public authority should provide sanitary pads to women for free.
In which countries do you get leave?
It was told in the petition that leave is given for menstruation in UK, Wales, China, Japan, Taiwan, Indonesia, South Korea, Spain and Zambia. In this, it was further told that in the Lok Sabha, the Union Minister had said in a written reply that there is no provision for menstrual leave in the Central Civil Services Leave Rules, 1972.
