The High Court on Monday rejected a plea seeking disqualification of Prime Minister Narendra Modi for six years for allegedly seeking votes for the Bharatiya Janata Party (BJP) in the name of Hindu and Sikh deities and places of worship. Is. This petition was filed by Anand S Jondhale, a lawyer by profession.
Justice Sachin Dutta said that the petition is completely misconceived as the petitioner has admitted that there has been a violation of the code of conduct, however, it is not acceptable for this court to direct the ECI (Election Commission) to take a particular view on any complaint . The court also recorded the submission of advocate Siddhant Kumar, appearing for the Election Commission of India (ECI), that the Commission would look into Jondhale’s complaint as per law.
He said that this is the speech of April 21, which is after his presentation. ECI receives such complaints on a daily basis, they have filed representations and we will take action on it. The Commission is a constitutional institution. Jondhale sought direction to the ECI to disqualify the Prime Minister from elections for six years under the Representation of the People Act. A further direction has been sought to restrain them from seeking votes in the name of religious deities and places of worship.
The petitioner was aggrieved by the speech given by PM Modi in Uttar Pradesh on April 9. Jondhale argued that the Prime Minister not only sought votes in the name of Hindu and Sikh deities and their places of worship, but also made comments against opposition political parties favoring Muslims. Jondhale’s complaint to the ECI said PM Modi said he had built Ram Temple, developed Kartarpur Sahib Corridor and brought back copies of Guru Granth Sahib from Afghanistan.
The petition states that in the interest of fair elections, it is expedient for the Election Commission to take immediate action against the Prime Minister, as the date of voting for the Lok Sabha elections is fast approaching. The petition said that Prime Minister Modi is planning to make the same derogatory speech across India while traveling in Indian government planes and helicopters.
