That is, if a person dies due to a bullet fired by an NSG commando, a case will be registered against the NSG commando under section 302. This section has now become section 103 in the Indian Judicial Code. If an NSG commando is found guilty, he will be punished the same way as a common man.

What if you get shot during an operation?

If an NSG commando accidentally shoots a common man during an operation and the common man dies, then in that situation the civil court can take cognizance of the matter itself. Actually, only army personnel are prosecuted in the Army Court. NSG commandos do not come under the Army. Indian Army personnel are not even recruited in it. This special force reports to the Home Ministry. Whereas, the Indian Army comes under the Ministry of Defense.
