The court has also expressed concern
Now there is no doubt that in most of the cases women have to face domestic violence, the statistics of the last several years testify to this. Troubled by dowry, discord and fighting in the family, many women commit suicide. However, in the past few years, the number of false cases against husbands has also increased rapidly. Concerns have been expressed regarding this from the High Court to the Supreme Court and verdicts have also been given in some cases. The Supreme Court has clearly said that the law (Section 498A) cannot be misused just to take revenge from the husband.

What is section 498A?
Now after the Bengaluru case, there is a lot of mention of Section 498A, under which many women file cases against their husbands. This includes cases of mental and physical harassment against married women. In this, the husband can be punished with both imprisonment of up to three years and fine. The biggest thing is that it is not possible to get bail under this section, because it is a non-bailable offence. Earlier there was a provision for immediate arrest in this case, but after an order of the Supreme Court, immediate arrest is not made.

What do the figures say?
Now if we talk about statistics, more than one lakh cases are registered every year under Section 498A. Most of these cases collapse as soon as they go to court or are resolved through mutual consent. In most cases only compromise has been seen. Now if we talk about the conviction rate i.e. punishment rate in law, then it is around 18%. That means in 82 percent of the cases either a settlement is reached or these cases are not proved in the court.

Now if we talk about false cases, the latest figures have not been released, but you can understand it from the figures of a few years ago. Between 2011 and 2013, there were 31292 cases in which the wife made allegations of cruelty against her husband, but these cases proved to be false. The court gave relief to the husbands in these cases and ended the case there itself. Then the Minister of State for Home had presented these figures in the Lok Sabha.
