Kerala High Court: The Kerala High Court has said that in other cases including sexual offenses, it is not always right to guess that whatever the complainant has said is true because nowadays the practice of implicating innocent people has started in such cases. Justice PV Kunkrishnan made this comment with anticipatory bail to the person accused of sexually assaulting a former female employee.

The High Court also narrated a lot to the police in this case. The court said that the police should not only listen to the complainant or the victim, but the complaints of the accused should also be investigated.

Justice PV Kunkrishnan said, ‘The complainant is a woman, it does not mean that the case should be unilaterally investigated. It cannot be estimated that women’s statements are completely true in all cases. It should not be that in such cases the police move forward on the basis of the statement of the woman without considering the matter of the accused. Nowadays there is a tendency to trap innocent people with serious allegations of sexual harassment.

‘Action should also be taken against the complainant’
Justice Kunkrishnan also said that if the police feel that the allegations of such women against men are false, then they can also take action against the complainants as the law allows it. He also said that the damage done to a citizen due to false allegations cannot be repaid only by paying money.

Justice said, ‘A false complaint can ruin his honesty, status, prestige etc. in society. Police officers should be cautious and vigilant to find out the truth in criminal cases during the investigation. Therefore, before submitting the final report in criminal cases, it is the duty of the police to separate lies from the truth.

The court said that this was a case where the investigating officer should have also investigated the complaint of the accused. The court also directed that if the woman is found to be presenting a false case, then appropriate action should be taken according to the law.

What was the matter?
The woman alleged that the manager of the company held her hand with wrong intentions. At the same time, the accused had complained to the police about the abuse and threats of the woman. The accused also handed over audio recording of the threats of the woman to the police. The accused said that if he fired the woman from the job due to not working properly, then the woman abused her and threatened her.
