Bihar Deputy Chief Minister Tejashwi Yadav has moved the Delhi High Court seeking a stay on the summons issued by the Central Bureau of Investigation (CBI) for questioning in the land-for-job case. Justice Dinesh Kumar Sharma’s bench will hear the matter on Thursday.

Tejashwi’s plea said that a notice under Section 160 CrPC can be issued only to a person who is located within the local jurisdiction of that police station or within the adjoining police station. Therefore, the notices issued are in gross violation of the provisions of CrPC, particularly section 160. The petitioner is a permanent resident of Patna, Bihar. CBI has summoned him to New Delhi. This is a violation of the law.

In the petition, Tejashwi has appealed to the court to issue a direction to the CBI that whenever he is questioned as per the directions of the Supreme Court, his lawyer should be present and listen to him.

Earlier, Tejashwi Yadav did not attend the CBI inquiry for the third time on Tuesday in the land scam case in lieu of job. Officials had said that for not appearing on March 4 and March 11, Tejashwi Yadav was given a notice to appear for questioning on Tuesday. Tejashwi did not appear for questioning even on the third notice on Tuesday. The CBI recently questioned Tejashwi Yadav’s father and Rashtriya Janata Dal (RJD) chief Lalu Prasad Yadav and his wife Rabri Devi. Lalu was questioned in Delhi and Rabri in Patna.

What is land for job scam?

  • Vijay Singla, nephew of Pawan Bansal, who was the railway minister in the UPA government, has also been accused of another scam related to railway recruitment.
  • In the case too, the CBI has registered an FIR against 10 including Vijay Singla. Vijay Singla is also accused of money laundering in this case.
  • Between 2004 and 2009, Lalu Prasad Yadav was the Railway Minister in the UPA government. It is alleged that there was a scam in railway recruitment when Lalu was the railway minister. It is being said that instead of getting jobs, land and plots were taken from the applicants.
  • CBI after investigation in this matter registered a case against Lalu Prasad Yadav and his daughter Misa Bharti. It is alleged that the lands that were taken were also taken in the name of Rabri Devi and Misa Bharti.
