The Patna High Court said that there is no provision in the latest service rules for employed teachers (Panchayat teachers) which says that teachers who fail to pass the competency test will be removed from their services. The High Court made this comment while disposing of several petitions on Tuesday. High Court Chief Justice K. A bench of Justices Vinod Chandran and Harish Kumar said that the service conditions would be better for those who have cleared the competency test. Better service conditions are merely a recognition of their capabilities. Additionally, those who did not pass the test or refused to take the test will still retain their jobs.

These are the rules under Special Teacher Rules-2023

Actually, there are 3.5 lakh contractual teachers in the government schools of Bihar, who will get the status of government employees after passing the competency test. Under the Special Teacher Rules-2023 of the Government of Bihar, it is necessary to qualify the competency tests to obtain the status of a government employee. Every teacher is given five attempts to pass the exam, three through online and two through offline mode. Under the Special Teacher Rules-2023, those who fail in the competency test also cannot be dismissed.

Let us tell you, the appointed teachers were appointed under the Bihar Panchayat Primary Teacher (Appointment and Service Conditions) Rules, 2006 (in short Primary Teacher Rules 2006) and later they were amended under the Bihar Panchayat Teacher Rules, 2012 (in short ‘Panchayat Teacher Rules) -2012).

Cabinet Minister said – Misleading information will be banned

Senior JDU leader and Bihar Parliamentary Affairs Minister Vijay Kumar Chaudhary reacted to the Patna HC order. He said that the state government had never thought of dismissing those employed teachers who could not pass the competency test or who did not appear in the examination. He told that some misleading information was being spread regarding the employed teachers and Special Teacher Rules-2023, on these reports the High Court has issued an order, so that the misleading information can be stopped.
