PM Modi Cabinet Meeting Decision: After the Supreme Court’s recommendation regarding reservation for Scheduled Castes (SC) and Scheduled Tribes (ST), the Union Cabinet refused to implement it. Giving information in this regard, Union Information and Broadcasting Minister Ashwini Vaishnav said on Friday (09 August) that there is no provision for the ‘creamy layer’ in the Constitution given by Bhim Rao Ambedkar.

Giving information about the decisions taken by the Union Cabinet, Ashwini Vaishnav said that in the cabinet meeting, there was a detailed discussion on the recent decision of the Supreme Court in which some suggestions were given regarding reservation for SC and ST. ‘Creamy layer’ means those people and families of SC and ST communities who fall in the higher income group.

What did Ashwini Vaishnav say?

He said that it is the considered opinion of the cabinet that the National Democratic Alliance government is committed to the provisions of the Constitution. Vaishnav said, “According to the Constitution given by BR Ambedkar, there is no provision for ‘creamy layer’ in SC-ST reservation.” He said that the provision of SC-ST reservation should be in accordance with the Constitution.

When asked whether the issue was raised by the Social Justice and Empowerment Minister or the Prime Minister, Vaishnav said that this is a well-considered view of the Cabinet.

What did the Supreme Court say?

The Supreme Court recently ruled on August 1 that states must identify the creamy layer within the Scheduled Castes and Scheduled Tribes and exclude them from quota benefits. The court delivered a majority verdict allowing sub-classification within SC and ST reservations, overturning its earlier order in the EV Chinnaiya case, which held that such sub-classification was impermissible as SCs and STs were considered ‘homogeneous classes’.
