What is open?
Khula is an Islamic legal provision that gives Muslim women the right to unilaterally divorce their husbands. Under Khula, a Muslim woman can divorce her husband by sending him a divorce deed. She does not need permission from her husband or anyone else. It is not necessary to give any reason for opening the case. The woman can open it as per her wish. Once given openly, divorce takes place and both the husband and wife get separated. This is a special right given to a Muslim woman by which she can end the marriage of her own free will.
How to take it open?
To give Khula, a “talaqnama” is written by the wife in which she declares the divorce given to her husband. This talaqnama is in written form and is signed by the wife. Along with this, there are also signatures of two witnesses who testify on this. Once this written talaq deed is sent by the wife to her husband and the husband accepts it then Khula becomes effective and if it does not then the wife has to go to the Qazi., Through this written document the wife gets legally separated from her husband.
No need for court action
Khula is a divorce which a Muslim woman can do without any court action. After giving Khula, the wife does not need to file any case in the court. In Khula, the woman can divorce her husband unilaterally and voluntarily by sending a written divorce certificate to her husband. Once the husband receives the talaq deed, if the husband accepts it, it is considered a divorce. After this there is no need for any kind of court intervention.
