SC Collegium : The name of senior advocate Saurabh Kripal has once again been sent to the Central Government for appointment as a judge in the Delhi High Court. Saurabh, son of former Supreme Court Chief Justice BN Kripal, has been working on LGBTQ rights. He himself is openly gay. Since 2017, Kripal’s appointment has been stuck due to some objections of the government. Now it is expected that in the next few days that historic occasion will come, when a person from the LGBTQ community will hold this high constitutional post.
The recommendation of his name was sent by the High Court collegium in 2017. After this, the Supreme Court Collegium also sent his name to the Centre. But the matter remained stuck due to the disagreement of the government. Now once again the collegium of Chief Justice DY Chandrachud, Justice Sanjay Kishan Kaul and KM Joseph has sent his name back to the government.
Government said ‘objectionable’ in terms of security
The Supreme Court Collegium has recommended Kripal’s name to the Center more than once. Every time the Central Government has told in response that the Intelligence Bureau (IB) has given a report against this appointment. In that report, Saurabh’s partner being of foreign origin and working for the Swiss Embassy in Delhi has been said to be objectionable in terms of security. Now the collegium has rejected this objection and said that the husband or wife of many people sitting on big positions in the country have been of foreign origin. Saurabh, who started his career as a junior in the chamber of former Attorney General Mukul Rohatgi, has an image of a hardworking and capable lawyer. Stamping his ability, all the 31 judges of the Delhi High Court unanimously gave him the status of senior lawyer.

Saurabh Kripal has done Honors in Physics from St. Stephen’s College, Delhi and law from the prestigious Oxford and Cambridge universities abroad. He was also active in the legal battle against Section 377 of the IPC, which criminalized homosexuality. He cross-examined in the court for the petitioner Navtej Johar. It is believed that his appointment as a High Court judge will be helpful in breaking the established notions about this class in the society. Will encourage the lawyers of LGBTQ class. Due to increasing acceptance in the society, people of this class will be able to join the mainstream in other areas as well.
Recommendation was returned on the basis of IB report
On the basis of the IB report, the Center had returned the recommendation to appoint advocate Somashekhar Sundaresan as a judge of the Bombay High Court. But the Collegium has again sent the recommendation of his name to the Center. The Center had said that Somashekhar has been voicing his opinion on social media. But the collegium has said that this is not a disqualification. Every citizen is free to express his opinion.
