According to Stamp and Registry Minister (Independent Charge) Ravindra Jaiswal, the objective of these policies is to increase harmony and brotherhood in homes, protect farmers from fraud and make women financially strong.

Lakhs of disputes over ancestral land will end in one fell swoop

Lakhs of cases related to ancestral land have been buried in court files for decades. Due to lack of division, brothers have become enemies. A proposal has been prepared to end this bitterness. According to this, all the claimants on the land from the entire family will be called together and divided on the spot. In lieu of this, only Rs 5,000 stamp duty will be charged.

Right now there are three ways of partition, all three are complicated.

– Suppose there is a 100 year old ancestral land. Whose price is one crore rupees. There are 36 claimants from the family on it. So right now these are the three ways of distribution. First way, everyone will go to the tehsil. The family register will be made there. It has to be said that 36 people are claimants and have decided among themselves as to how much portion of that land each family will occupy and where it will reside. Now an accountant is appointed to measure the land. From there the matter starts hanging. It takes from ten years to forty years.

– Second way, the matter goes to court. The case continues in the family. It takes years to reach a decision. There itself,

The third way is that all the claimants reach the registry department together and apply for settlement. Under this, there is a provision of only 30 percent rebate in stamp duty applicable on property. If there is property worth Rs 1 crore. If the stamp duty is Rs 7 lakh then there will be a discount of Rs 2.10 lakh on it. This is the root of the dispute that when the property is ours then why pay a stamp of Rs 4.90 lakh. Then the second bone of contention is who should give it. Ultimately the matter hangs. This is the reason why the applications for partition falling under this rule are less than one percent. However, now preparations have been made to bring a fourth way. All the claimants will reach the registry department and give their respective shares in writing. The property will be settled and divided on a stamp of only Rs 5,000.

To protect farmers from fraud, power of attorney divided into three parts

More than two lakh farmers were victims of fraud. This fraud was being done in this way. Suppose a builder bought land worth Rs 1 crore from a farmer. Instead of registration, power of attorney was taken from the farmer on a stamp of Rs 100. Then the land was developed and divided into plots and sold for Rs 4 crore. The builder used to get those plots registered directly from the farmer. That means, an earning of Rs 4 crore was credited to the farmer’s account on paper. The Income Tax Department used to send them notices and the builder would leave with the money. Due to this, stamp duty was also being evaded. In Western UP alone, two lakh farmers were victims of this fraud. Therefore the power of attorney was banned. Due to this, about 30 lakh farmers were saved from fraud. In view of this, the power of attorney was also divided into three parts.

1- Only Rs 100 for Caretaker: Giving power of attorney to someone to take care of the property will cost only Rs 100.

2- Stamp on gifting property to blood relations only Rs 5,000: In the case of father, mother, husband, wife, son, daughter-in-law, daughter, son-in-law, brother, sister, grandson, grandson and widowed daughter-in-law, the stamp duty is Rs. 5,000. On granting the right to sell immovable property through this, only stamp duty of Rs 5,000 will be levied.

3. Full stamp duty outside blood relations: Apart from the above, on making power of attorney in the name of anyone, the same stamp duty will be applicable as is normally applicable on the purchase and sale of property. That means seven percent stamp duty will have to be paid.

Circle rate has not increased for seven years

Circle rate has not increased in the last seven years but stamp revenue is continuously increasing. Earlier the circle rate used to increase by ten percent every year. That is, by not increasing it in seven years, Rs 35 thousand crores have been saved every year by those who have bought and sold property during this period. So far, relief worth more than Rs 2 lakh crore has been received.

Women also own property

The gift deed of five thousand rupees gave women a lot of property rights. Brother donated property to sister, father to daughter, husband to wife and father-in-law to daughter-in-law. In just three years, about 31 lakh properties were transferred to the names of women. Last year, on Raksha Bandhan, brothers gifted Rs 44,000 worth of property to their sisters.

Wealth and Social Relations expert Dinesh Chandra Shukla says that property is the root of dispute for about 45 percent of the villages and 30 percent of the cities.
