Where have most fake encounters taken place

According to a report by Dainik Bhaskar, in 2018, the highest number of fake encounter cases in the country were reported in Uttar Pradesh. This year, about 77 percent of the encounters in UP were fake. In fact, on 6 January 2019, Minister of State for Home Hansraj Ahir told the Rajya Sabha that 22 fake encounters took place in the country in 2018.

In these cases, there were 17 fake encounter cases from Uttar Pradesh alone. According to the report of the Human Rights Commission, the amount of compensation given by the Uttar Pradesh government due to fake encounters between 2012 and 2017 was Rs 13 crore 23 lakh.

When is an encounter declared fake?

In fact, when an encounter by the police is seen to take place under suspicious circumstances or a person is killed in an encounter without following the legal procedure, then it is called a “fake encounter”. However, whether an encounter by the police is fake or not is decided only by the court or the investigating agencies after investigation.

Under what circumstances do police conduct encounters

In some special circumstances, in case of self-defense or necessity, the police can encounter the criminal. For example, Section 96-106 of the Indian Penal Code (IPC) gives the right to self-defense. According to this, if a policeman or any person uses force to save his life, it will be considered self-defense. The amount of compensation given was Rs 13 crore 23 lakh.
