Demand to break the structure inside the archaeological park

In this petition, the religious structures inside the Archaeological Park have been requested to be saved from demolition. Senior advocate Nidhesh Gupta, citing the status of Archaeological Survey of India (ASI), said that a historic monument found there was built about 700 years ago.

‘People encroach to earn money’

The Chief Justice said that people keep encroaching to earn money and keep setting up shops. He asked ASI to plan to ensure that there was no further encroachment. Additional Solicitor General KM Nataraj said that we find out which (buildings) are new and which are old. ”

A lawyer said that these monuments have not been declared preserved, so if they are repaired then there is no problem. The bench said, “Permission will be required under existing laws for repair. The ASI has submitted an interim status report. The original structure was to be detected and verified. The matter will have to be listed for April 28. The ASI will have to submit further status report and the side can file their objections/representations. No construction should be done at the current site. ‘

What did ASI say?

The ASI had earlier said that these two structures have religious significance inside the archeology park, because Muslim devotees visit the Aashiq Allah Dargah and Sufi saint Baba Farid every day. The ASI had said that the tomb is close to the fort of Prithviraj Chauhan and falls in a 200 meter regulated area under the ancient monument and archaeological site and relics Act. He had said that any repair, or construction work requires prior permission of the competent authority.

Jumlana had said in his petition that the Delhi Development Authority has planned to demolish them without assessing the historical importance of these structures in the name of removing encroachments. He moved the apex court against the Delhi High Court order on February 8, stating that the religious committee headed by Delhi Lieutenant Governor VK Saxena can consider the matter. Jumlana argued that the committee is not a suitable platform to decide the antiquity of a structure.
