Mathura Shahi Masjid Case Hearing: The Supreme Court on Friday (January 5) rejected a public interest litigation (PIL) seeking recognition of the Shahi Idgah mosque site in Mathura as Krishna’s birthplace and removal of the mosque.

Earlier, Allahabad High Court had also rejected such a petition, against which an appeal was made in the Supreme Court. However, the Supreme Court said that the petitioner can file a separate petition challenging the validity of any law.

The petitioner claimed the mosque to be a temple
The hearing was held on Friday before the bench of Justice Sanjeev Khanna and Justice Dipankar Dutta in the Supreme Court. Advocate Mehak Maheshwari had filed a petition in the Supreme Court after the Allahabad High Court rejected the PIL last October. He had demanded recognition of the disputed site as the actual birthplace of Hindu Lord Krishna and had urged handing over the land to Hindus for setting up a trust for the Krishna Janmabhoomi birthplace. Through the PIL, the lawyer had claimed that the site predates Islam and questioned the validity of the agreements made in the past regarding the disputed land.

Several civil suits are already pending”

At the beginning of the hearing, Justice Khanna told the lawyer appearing for the petitioner that there was no need for a PIL as several civil suits were pending on the same issue. In response, the lawyer complained that the High Court had dismissed Maheshwari’s petition only on the ground that other cases were pending.

Justice Khanna said, “You filed it as a PIL, so it was dismissed. File it as a normal litigation, we will see.” On this the lawyer asked whether I could file a separate petition on this. On this the judge clarified that it can definitely be done, but not in the form of a PIL.

Let us tell you that the claim that this mosque was built by demolishing the temple of Lord Shri Krishna was made in the Allahabad High Court. The petitioner had said that the grandson of Lord Shri Krishna had built the Mathura temple. The land for the temple was donated, so there is no dispute over the ownership of the land. The land is still registered in the name of Katra Keshav Dev in the revenue records. Earlier, the petition in Allahabad High Court had claimed that the birthplace of Lord Shri Krishna is below the mosque and there are many signs there, which establish that the mosque was a Hindu temple. There is a lotus-shaped pillar, a feature of Hindu temples, and a replica of Sheshnag, one of the Hindu deities who protected Lord Krishna on the night of his birth.

There was an agreement regarding the land
According to the petition filed in Allahabad High Court, a settlement was reached on 12 October 1968 in the case of Shri Krishna’s birthplace Shahi Idgah. In this agreement signed between Shri Krishna Janmabhoomi Seva Sangh, an associate organization of Shri Krishna Janmasthan Trust, and Shahi Idgah, out of 13.37 acres of land, about 2.37 acres of land was given for Shahi Idgah. However, after this agreement Shri Krishna Janmabhoomi Seva Sangh was dissolved. The Hindu side is calling this agreement illegal. According to the Hindu side, Shri Krishna Janmabhoomi Seva Sangh had no right to negotiate.
