The Supreme Court has refused to accept the appeal of Madan Mohan Malviya University of Technology (MMMUT) to consider the admission cancellation case. Rejecting the appeal, the Supreme Court directed the same single bench of the High Court to consider the case on merits, which had set aside the university’s decision of cancellation of admission.
Also, the university administration was instructed to make the students a part of their educational institution again. Refusing to hear the case pending in the High Court, the Supreme Court asked the students to dismiss the appeal if they do not withdraw it. After this the students decided to withdraw it with immediate effect.
Actually, the university had appealed in the double bench against the decision of the single bench of the High Court. While returning the case to the single bench, the double bench had said the same thing as the Supreme Court. The Supreme Court has also directed the single bench of the High Court to hear the matter seriously and take a decision without coming under the influence of the double bench.
On January 10, 2023, after a confidential investigation of four months, the MMUT administration had canceled the admission of 40 students who had enrolled in the B.Tech course on the basis of forged documents. These included 22 from session 2020-21 and 18 from session 2021-22. Of these, 35 students took refuge in the High Court against the decision of the university. When the decision came in favor of the students from the single bench of the High Court, the university appealed in the double bench.
The double bench returned the matter for consideration to the single bench saying that the university’s stand was ignored while taking the decision. After that the students appealed to the Supreme Court for relief. Vice Chancellor Prof. JP Saini Told that the matter has come back to the High Court from the Supreme Court.
