The Supreme Court on Monday set aside the Punjab and Haryana High Court order deleting adverse comments made by Haryana Chief Minister Manohar Lal Khattar in the Annual Performance Appraisal Report 2016-17 of senior IAS officer Ashok Khemka. Khemka came into limelight in 2012 after canceling the mutation of a land parcel following a deal between Congress leader Sonia Gandhi’s son-in-law Robert Vadra’s Skylight Hospitality and real estate major DLF.

A bench of Justices Vikram Nath and Satish Chandra Sharma said the accepting authority has not yet decided on the comments and representations made by Khemka for overall grading. We are of the opinion that the Division Bench of the High Court has committed an error in law. We have canceled the decision of the division bench of the High Court.

Further, as we have been informed, the accepting authority has not yet taken any decision. Decision on the underlying representations, We direct the accepting authority to take a decision on the underlying representations under Rule 9(7B) of the PAR (Performance Appraisal Report) Rules within a period of 60 days from the date of announcement of this decision.”
