‘There is no ban on arrest of Shahjahan Sheikh’, High Court said on Abhishek Banerjee’s claim


Calcutta High Court on Sandeshkhali Case: Calcutta High Court, taking suo motu cognizance of the Sandeshkhali case, started hearing on Monday (26 February). During the hearing in the court, the comments of TMC MP Abhishek Banerjee and two ministers of Bengal were also discussed.

The CJ said that we will direct the registry to issue a public notice in the newspaper because Shahjahan Sheikh is missing. The High Court judge said he would clarify that there is no bar on police action against Shahjahan, as claimed by TMC leaders.

Trinamool Congress general secretary and Diamond Harbor MP Abhishek Banerjee on Sunday (February 25) blamed the judiciary for the delay in the arrest of absconding Sandeshkhali leader Shahjahan Sheikh. Speaking to media persons during an event on Sunday, Abhishek had said that Shahjahan Sheikh is being protected by the judiciary so that the message remains and burns in the headlines. He said that when Trinamool Congress accused Partha Chatterjee, Jyotipriya Mallick If you don’t leave him then who is Shahjahan Sheikh?

In fact, a team of the Enforcement Directorate had gone to Sandeshkhali on January 5 in search of Shahjahan Sheikh in connection with the ration scam. There his supporters attacked the ED team, in which many officers were injured. On January 16, Justice Jai Sengupta of the Calcutta High Court had ordered a joint investigation following a petition filed by the ED, days after the attack on its officials. The Calcutta High Court had ordered a special investigation team with officials from both the state police and the CBI. Abhishek said that after a few days, ED demanded its postponement, which was accepted by the High Court.

It is reported that the ED and the state police then filed separate petitions before a division bench headed by Chief Justice TS Sivagnanam seeking permission to investigate the case independently. The division bench, in an order issued on February 7, stayed the state police action and investigation. It also stopped the investigation of the case till the next hearing on March 6.
