While hearing the case of Toyota Fortuner’s airbag not opening in the accident, the State Consumer Commission ordered the company to pay Rs 20 lakh as compensation, Rs 1 lakh as damages and Rs 25 thousand as litigation expenses. While giving this verdict, the Commission’s Chairman Justice Ashok Kumar has also ordered to pay 9 percent annual interest on it from the year 2018. In this way, the company will have to pay about 31 lakh rupees including interest. The case is related to Raebareli.

According to the complaint filed by Raebareli District Panchayat President Awadhesh Bahadur Singh in the Commission, on 10 November 2018, his driver and guard were going to drop his son at Amausi Airport. Due to an oil tanker suddenly coming on the road near Bachhrawan, the Fortuner went out of control and collided with an electric pole and got badly damaged. The accident was so severe that the carbine of the security guard sitting in the car broke into two pieces and all three people were injured, but the airbags of the car did not open.

Six days after the accident, the government surveyor inspected and reported that the airbags should have opened considering the severity of the accident. The company also gave assurance but took no action. Hurt by this, Avadhesh filed a claim in the commission demanding compensation, accusing the dealer Sunny Toyota and the company of deficiency in service. He presented the photographs of the accident along with the report to the commission. He also presented the facts regarding the recall of all the company’s vehicles across the world due to this defect. After hearing both the sides, the commission accepted that the airbags should have opened considering the severity of the accident and this was a deficiency in service. In lieu of this, the company was ordered to pay a total of Rs 31 lakh including interest.
