There has been a debate about period leave in India for years. Women say that they should get leave during periods. However, sometimes some women also oppose it. Case in Supreme Court

Let us tell you that the Supreme Court has directed the central government to make a model policy on period leave. But the bench of Chief Justice DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra said that period leave is an issue related to policy. The bench said that this cannot be considered in the court. Because if the bench gives a decision on this, it can be harmful and companies can avoid hiring women. 

Why period leave?

Many women, including men, also ask why period leave is needed. People who speak in favor of period leave said that women have to go through unbearable pain during this period. According to medical science, 200 types of changes take place in women before and during menstruation. These changes are not only physical but also mental. Professor Siobhan Harlow of Michigan University, America, says that 15% to 25% women experience tremendous pain during periods. 

Period leave in India 

Women get period leave in many countries around the world. However, there is no central law regarding this in India. However, in 2020, the Zomato company announced period leave. Zomato gives 10 days of paid leave every year. Apart from this, many startups also started giving such leaves. If we talk about the states of India, then only Bihar, Kerala and Sikkim have rules regarding period leave. People consider Bihar backward in many matters. But Bihar was the first state to give the right of period leave to its female employees. There is a law in Bihar since 1992 that women employees of the state government can take two days of period leave every month. However, this leave is available till the age of 45 years. In 2023, Kerala Chief Minister Pinarayi Vijayan announced period leave for girl students studying in government universities. Along with this, 73% attendance was made mandatory for female students instead of 75%.

No central law

There is no law or policy regarding this at the central level in India. Some MPs have presented private bills on period leave in the Parliament many times, but the matter could not move forward on that. In the last term, former Union Minister Smriti Irani had also opposed period leave. She had said that it is not a disease or disability, she said that there is no proposal regarding period leave.
