Where is the maximum reservation available in the country? Know what are the rules regarding this

The discussion has again intensified regarding the limit of caste reservation in the country. Actually, the Bihar government had decided that it would increase the limit of caste reservation in the state to 65 percent. But the Bihar High Court had put a stay on it. The Bihar government had approached the Supreme Court to get this ban lifted, but now the Supreme Court has rejected this demand of the Bihar government.

The bench headed by Chief Justice DY Chandrachud said during the hearing that we are issuing notice and the next hearing on this matter will now be held in September. Let us now tell you which state gets the highest reservation at present.

Reservation in Chhattisgarh

In December 2022, the Reservation Amendment Bill was passed in the Chhattisgarh Legislative Assembly. On the passing of this bill, the reservation in Chhattisgarh increased to 76 percent, which was the highest reservation available in any state of the country at that time. After the passage of this bill, the Scheduled Tribes of the state will get 32 percent reservation, Scheduled Castes 13 percent and Other Backward Classes 27 percent reservation. Along with this, the upper caste poor will get 4 percent reservation in this matter.

The bill was also passed in Jharkhand

Talking about Jharkhand, the Jharkhand Reservation in Vacancies of Posts and Services (Amendment) Bill, 2022 was passed by voice vote in the assembly there in November 2022. As soon as this bill was passed, the scope of reservation in the state increased to 77 percent.

What does the court say on these matters?

The Supreme Court may have ordered a hearing in September on the Bihar government’s case, but while hearing the Bihar government’s decision to take the reservation beyond the scope of 50 percent on June 20, the Patna High Court said that this rule violates Articles 14, 15 and 16 of the Constitution. For this reason, the rule of increased reservation in Bihar is rejected. Let us tell you, Articles 14, 15 and 16 talk about the rights to equality in employment opportunities, protection against discrimination.
