Aam Aadmi Party Withdraws Petition From Supreme Court Ann


MCD Election: Aam Aadmi Party candidate Shelli Oberoi has withdrawn her petition from the Supreme Court for the post of Mayor of Municipal Corporation of Delhi (MCD). The petition demanded early elections. Today it was withdrawn on the ground that elections are going to be held on 6 February. There was also a demand in the petition not to allow the nominated councilors to vote, but the court refused to give any order on this.

A bench of Chief Justice DY Chandrachud and Justice PS Narasimha said at the beginning of the hearing that the mayoral election has been fixed for February 6. Therefore, there is no need to hear the demand for early elections. On this, senior advocate Abhishek Manu Singhvi, appearing for the petitioner, reiterated the demand to keep the alderman (nominated councillor) away from voting.

‘Can file petition again’
The Chief Justice refused to give any order regarding the alderman, saying, “This is a different matter. If we hear it, the election will have to be stayed. You also do not want the election to be stopped. Therefore, this issue Let it be.” The judges allowed Singhvi to withdraw the petition and said that he can file the petition again if needed.

Election stopped due to controversy
The results of the MCD elections came on 7th December. In this, Aam Aadmi Party got 134 seats. BJP had won in 104 wards. Since then, the House met twice for the election of the Mayor, but due to the dispute between the two parties, the election could not be held.

The Aam Aadmi Party is opposing the participation of nominated councilors in the voting. He says that under Article 243R of the Constitution and Section 3 of the Delhi Municipal Corporation Act, nominated members do not have the right to vote.
