Aam Aadmi Party has raised serious questions on the disappearance of audio from the video footage presented by ED in the court in the so-called excise case. Senior AAP leader Jasmine Shah says that on February 3, an accused told the court that when he asked the ED for CCTV recording of his face-to-face encounter with one of the government witnesses, the ED gave only video footage. The audio was completely missing from the video. He said that you have come to know that this is not the first incident, but ED has made the audio of many other videos disappear.
Actually, this entire matter is fake. ED has based this entire case on the statements of government witnesses. ED should tell under whose pressure it disappeared the audio from the video, despite the court’s order to preserve the audio-video recording of the interrogation. He said that the basic objective of this case is to destroy the Aam Aadmi Party by arresting Arvind Kejriwal and other leaders.
Senior Aam Aadmi Party leader Jasmine Shah held a press conference at the party headquarters on Tuesday and raised questions on the ED investigation. He said that the so-called liquor scam of Delhi would be the first such case in the history of India, in which ED investigation is going on for the last two years. ED has conducted thousands of raids across the country till now, but not a single rupee has been recovered nor has any concrete evidence been found.
Despite this, big leaders of Aam Aadmi Party are continuously being sent to jail. Some of the people who were earlier accused in this case by ED have now become government witnesses. This entire case has been based on the statements of those government witnesses and a whole bunch of lies have been made.
He said that we need to understand how much truth is there in the statements of government witnesses. Last year, many accused and witnesses had gone to the court and said that they were intimidated and forced to sign the statement. A witness has given a written statement in the court that I was slapped so hard below my ear that my eardrums burst and I can no longer hear.
The second witness has said that the ED told him that if you do not name the big leaders of the Aam Aadmi Party, then we will see how your daughter goes to college? While another witness said that my wife was arrested, threatened and forced to sign a fake statement. These three witnesses have given this statement in written form before the court. From this it can be estimated how this investigation is going on.
Senior AAP leader Jasmine Shah said that on December 2, 2020, the Supreme Court had passed a historic order in the case of Paramveer Singh Sain vs Baljit Singh and others. The court has clearly stated in paragraph 17 of its order that every investigating agency of the country has to keep the recorded audio-video safe during interrogation. Because many such cases are coming in which statements of witnesses are being taken by threatening them.
Paragraph 19 of the order clearly states that the ED will also have to follow this order, so that the fundamental rights of the witnesses and the accused are not violated. The investigation into the so-called liquor scam is scheduled to begin in mid-2022. After this, on July 19, 2023, ED Special Court Judge MK Nagpal had also reiterated this order of the Supreme Court in the liquor scam case. Because one of the accused had demanded CCTV recording of the interrogation.
