Allahabad High Court: The Lucknow bench of the Allahabad High Court has directed the state government to increase the retirement age of teachers in Lucknow University from 62 years to 65 years. The court gave this decision by the single bench of Justice Om Prakash Shukla while hearing the petition of Dr. Prem Chandra Mishra. The court said that amendments in this regard should be done within three months.
The petitioners submit that they were entitled to continue their services as teachers in the concerned university till the age of 65 years and have relied upon three similar orders passed by a coordinate bench of the Court in similar situations. The petitioner has claimed in the writ petition that he is working as a psychology professor in Lucknow University. He retired in July 2020 at the age of 62. Although the petitioner was given the benefit of the session, so he retired in June 2021.
Lucknow University failed to amend the laws
The petitioners stated that the Government of India, through the Ministry of Human Resource Development, Department of Higher Education, had decided to increase the age of superannuation for all persons holding teaching posts on regular employment against sanctioned posts. In the above chronology, the Government of India has decided to revise the pay scales of teachers in Central Universities on the recommendation of the University Grants Commission, which is subject to various provisions of the scheme of pay scales contained in 31 December 2019.
The petitioners state that the salary of teachers in state universities, including Lucknow University, was revised under the scheme, but Lucknow University failed to amend its laws to bring the retirement age of teaching staff in line with the scheme. Could
