Both Chief Minister Nitish Kumar and Deputy Chief Minister Samrat Chaudhary are not members of the Bihar Assembly. Meaning, they have not been elected directly from the public. Both are members of Bihar Legislative Council. Being the Chief Minister and the Deputy Chief Minister, both will be present in the Assembly during the majority test, but since they are not MLAs (Assembly Members), they will not be able to vote. JDU has 45 MLAs in Bihar Assembly, but Legislative Council member Nitish Kumar is the Chief Minister. Similarly, Bharatiya Janata Party, which has 78 MLAs, has given the second position in the government to Bihar Legislative Council member Samrat Chaudhary.

In the Bihar Assembly elections 2020, Nitish Kumar had secured the mandate to run the government with the BJP. In between, he had left BJP and was on the chair to run the grand alliance government with Rashtriya Janata Dal-Congress-Left parties. As long as he remained in office as the Chief Minister of the Grand Alliance, Samrat Choudhary remained his attacker as the Leader of Opposition in the Legislative Council. Before the change of government on January 28, he was summoned to Delhi and advised to stop the attack. After that his attitude relaxed and then as soon as Nitish Kumar became his deputy on January 28, he became comfortable with him. Now both are together and are preparing to show the strength of their 128 supporting MLAs in the Bihar Assembly, more than the magic figure of 122, during the floor test of the government on Monday.
