Revenue and Land Reforms Department Minister Dr. Dilip Kumar Jaiswal said that the condition of land records in Bihar is not good. It has been 100 years since the Cadastral Survey and more than 50 years since the Revisional Survey. A large number of land documents have been destroyed due to flood, fire and termite infestation. In such a situation, people were afraid that due to lack of documents, their land might be lost from their hands. We have worked to remove their fear. It is expected that now people will actively participate in the land survey work and now the speed of land survey will also increase. The Minister said that the Revenue and Land Reforms Department is continuously active in resolving the problems related to land disputes in Bihar. In this sequence, the department is continuously trying to identify the problems of the farmers and solve them.

Now Khatian will be made on the basis of receipt

Additional Chief Secretary of the department, Deepak Kumar Singh said that this is an important step in the direction of determining the jurisdiction of Khasars under the process of creation of Khatian, i.e. record of rights of ryots under the Bihar Special Survey and Settlement Programme. He also said that all the instructions will be valid from the date of implementation of Bihar Special Survey and Settlement Rules, 2012. He said that the ryot has occupation of the ryati khesra but the ryot does not have any document related to ownership of the land or has only a tax receipt in the name of the documents, in such a situation Khatian will be created only on the basis of that receipt.

The name of the title holder is also important evidence

Additional Chief Secretary Deepak Kumar Singh said that if the tenant has peaceful occupation of any land, then the statement of the Chauhaddidars of the Khesra will also be an important evidence, as well as the name of the title holder in the sale, exchange or registered distribution of land in the Chauhaddi of that Khesra. Will also be considered important evidence and that will also be the basis for determining ownership. If there is only encroachment and possession of the land by the tenant, neither the jamabandi is maintained with the documents nor the rent receipt is being deducted, then the account will be opened in the name of Bihar Government but the name of the illegal encroachment will be recorded in the remarks column. Based on mutual consent, the accounts of all the stakeholders will be opened separately based on the division signed by all the parties, if there is disagreement then a joint account will be opened.

It is not mandatory to get the filing rejected

Additional Chief Secretary said that if a person has purchased registered land but has not got the registration done, then it is not mandatory to get the registration done. The surveyor can also open an account in the name of the buyer after being satisfied about the peaceful occupation and authenticity of the Kewala. He said that the entire situation has been clarified through a notification on sixteen questions of such ownership. Now, in case of any ambiguity or dispute, it will be easier for the survey workers to take decisions. The Survey Directorate was often being requested by the settlement offices to clarify these questions. Land survey work has started in all the areas of Bihar in August 24. At present the work of writing the papers and submitting the self-declaration is going on. In such a situation, the arrival of this notification will provide great convenience to the common people and the situation of confusion and doubt will end.
