The Supreme Court on Tuesday (January 7, 2025) refused to consider a petition related to alleged irregularities in the Bihar Public Service Commission (BPSC) examination held on December 13, 2024, and police action on protesters. A bench of Chief Justice Sanjiv Khanna, Justice Sanjay Kumar and Justice KV Vishwanathan asked the petitioner to approach the Patna High Court with his complaints.
Advocate appearing for the petitioner ‘Anand Legal Aid Forum Trust’, while urging the court to consider the petition, said that the country has seen the brutal action of Bihar Police on the peaceful protesters who demanded cancellation of the controversial BPSC examination. Did. Justice Sanjeev Khanna said, ‘We are asking you to knock the door of Patna High Court.’ However, the petitioner said, ‘This paper leak is a daily affair.’
CJI Sanjiv Khanna said, ‘We understand your sentiments… but we cannot be the court of first instance and we feel that it would be appropriate (from the point of view of judicial process) and also from the point of view of a speedy hearing that the petitioner should be informed in accordance with the Constitution. Approach the Patna High Court under Article 226 of the Indian Penal Code.
The petitioner told the bench that the place where the police had lathicharged the protesters was near the official residence of the Chief Justice of Patna High Court and suo motu cognizance could have been taken on it. Bihar Police allegedly used force to control civil services exam candidates demanding cancellation of the BPSC exam held on December 13, 2024.
The State Public Service Commission has ordered re-conduct of the examination for some candidates on January 4 at 22 centers in Patna. Of the 12,012 candidates eligible for re-examination, a total of 8,111 downloaded their admit cards and only 5,943 appeared in the examination. Jan Suraj founder Prashant Kishor was on an indefinite fast at Gandhi Maidan in Patna demanding re-examination, who was arrested and later released on bail.
