Can traffic police arrest you?
According to the Motor Vehicles Act, the traffic policeman can arrest the offender in case of offenses falling under certain sections. The traffic police have been given certain powers to arrest without any warrant. It is written in the Motor Vehicles Act that if a person has committed a punishable act under section 184, 185, 197 in the presence of the police, then a uniformed policeman can arrest him.
When can you arrest without warrant?
Any police officer in uniform can arrest anyone under these circumstances even without a warrant.
1. If any person refuses to give his name and whereabouts under the provisions of the Act or if the police believe that he is false, he can be arrested.
2. If any person has been concerned in any offense under this Act and the police believe that he will abscond or try to evade the service of summons, he may be arrested.
3. Dangerous driving (Section 184), driving under the influence of intoxicants (Section 185), driving without the owner’s consent or lawful authority (Section 197) and refusing to give his name and address Or he can be arrested if there is a possibility of absconding.
