The high court was hearing a plea by Swamy seeking to produce evidence before the trial court in the National Herald case, in which Rahul Gandhi and others are accused. On February 22, 2021, the court had issued notices to the Gandhi family, All India Congress Committee (AICC) general secretary Oscar Fernandes (post-death), Suman Dubey, Sam Pitroda and Young India (YI) seeking their stand on Swamy’s plea.
The court on Monday said that the interim stay order will continue till the next date of hearing in the case. The Congress leaders were represented in the court through senior advocates RS Cheema and Tarannum Cheema. Swamy moved the high court against the trial court order of February 11, 2021, which had rejected his plea to produce evidence for prosecution of the Gandhi family and other accused in the case. The trial court had said that Swamy’s application to produce evidence under Section 244 of the Code of Criminal Procedure (CrPC) would be considered after the completion of his investigation in the case.
